Terms and Conditions
What you are agreeing to when you register a learner: places and payment, safety in the workshops, conduct, certificates and what happens if something changes.
Last updated September 2026 · version 2026-09
These Terms and Conditions apply to participation in programmes, courses, workshops, activities and services offered through Engaging Industrial Learning Activities (EILA).
EILA is a practical skills development programme. These Terms do not represent EILA as a separate incorporated company or legal entity.
By submitting a registration, making payment or participating in an EILA programme, the registering parent, guardian or participant agrees to these Terms and Conditions.
01Registration and Eligibility
EILA programmes are offered to learners within the age ranges specified for each programme.
Where the learner is under 18 years of age, registration must be completed or authorised by a parent or legal guardian.
The parent or guardian registering a learner is responsible for ensuring that the information provided to EILA is accurate and up to date.
EILA reserves the right to request additional information where reasonably necessary to confirm a learner's registration, age, emergency contact, or programme requirements.
02Programme Registration
Submitting a registration or enquiry does not, by itself, guarantee a place on a programme.
A learner's place is confirmed once the applicable registration requirements have been completed and the required payment has been received and confirmed, unless EILA expressly states otherwise.
Places may be limited for particular skills or training sessions.
03Programme Fees and Payment
Programme fees will be communicated through the official EILA website, registration materials or other official EILA communications.
Fees must be paid through the payment methods provided by EILA.
A registration is considered paid only when payment has been successfully received or confirmed.
Parents and guardians should retain their payment confirmation or transaction reference.
EILA is not responsible for delays caused by a payment provider, bank, mobile money service or other third-party payment system.
04Cancellations, Refunds and Transfers
EILA's cancellation and refund arrangements will depend on the programme and the circumstances of the cancellation.
Where a programme is cancelled by EILA before training begins, EILA will communicate the available options to affected participants, which may include transfer to another available session or a refund of applicable programme fees.
Where a participant cancels after registration, any refund or transfer will be subject to the cancellation terms communicated for that particular programme.
Once training has commenced, fees may not be refundable where costs have already been incurred or where the participant has received part of the training.
Where a learner is unable to attend a scheduled session, EILA may, at its discretion, offer an alternative session where capacity and programme arrangements permit. An alternative session is not guaranteed.
Any special refund or transfer terms communicated for a specific programme will take precedence over these general provisions.
05Changes to the Programme
EILA reserves the right to make reasonable changes to:
- training dates or times;
- venues;
- trainers;
- course content;
- available skills;
- programme schedules; and
- other operational arrangements.
Changes may be necessary because of trainer availability, venue circumstances, safety considerations, minimum enrolment numbers or other circumstances beyond EILA's reasonable control.
Where a significant change affects a paid booking, EILA will communicate the change and, where appropriate, provide an available alternative arrangement.
06Practical Training and Safety
EILA includes practical and technical activities that may involve tools, equipment, machinery, heat, electricity, materials or other workshop-related hazards.
Learners are required to:
- obtain a personal accident insurance cover before reporting for a session;
- follow trainer and programme instructions;
- use equipment only as instructed;
- observe workshop and safety rules;
- use protective equipment where provided or required;
- behave responsibly towards trainers, other learners and members of the public; and
- immediately report accidents, injuries, unsafe conditions or damaged equipment to a trainer or programme representative.
A learner may be removed from a practical activity if their behaviour creates a safety risk to themselves or another person.
Parents and guardians acknowledge that practical training carries inherent risks and agree that learners must follow all safety instructions and requirements.
07Conduct
EILA is committed to providing a respectful learning environment.
Learners are expected to treat trainers, staff, fellow learners, equipment and facilities with respect.
Bullying, harassment, intimidation, violence, deliberate damage to property, theft, serious misconduct or dangerous behaviour will not be tolerated.
EILA may suspend or remove a learner from a programme where their conduct presents a serious risk to themselves or others or substantially disrupts the learning environment.
Where appropriate, the parent or guardian will be informed.
08Learner Welfare and Safeguarding
EILA takes reasonable steps to promote the safety and welfare of participating learners.
Parents and guardians should provide accurate emergency contact information and disclose information that EILA reasonably needs to manage the learner's participation safely.
EILA should be informed of relevant allergies, medical or accessibility requirements where these may affect participation in practical activities.
EILA will handle such information in accordance with its Privacy Statement and applicable data protection requirements.
09Photographs, Video and Promotional Content
EILA activities may be photographed or recorded.
Participation in EILA does not automatically constitute consent for a learner's identifiable image to be used for promotional purposes.
Where a learner is a child, appropriate parental or guardian consent will be obtained before identifiable images or recordings are used for promotional purposes such as the EILA website, social media, advertising, brochures, reports or other public communications.
A parent or guardian may decline or withdraw promotional image consent in accordance with the EILA Privacy Statement.
10Training Materials and Intellectual Property
Training materials, documents, photographs, videos, graphics, logos, written content and other materials produced or supplied by EILA or its training partners remain the property of their respective owners unless otherwise stated.
Programme materials are provided for the learner's personal educational use.
They may not be reproduced, sold, distributed or commercially exploited without the permission of the relevant rights holder.
Learners retain ownership of original work they independently create, subject to any separate terms communicated for a particular project, competition or training activity.
11Certificates and Completion
Where EILA provides certificates, certificates will be issued only where the learner satisfies the applicable attendance, participation or completion requirements communicated for that programme.
Participation in an EILA programme does not automatically constitute a professional qualification, trade licence, employment placement or accreditation unless this is expressly stated for the particular programme.
12Third-Party Trainers and Partners
EILA may work with independent technical trainers, training organisations, venues, sponsors and other programme partners.
These partners may provide specialist instruction, facilities, equipment or other services.
Their involvement does not make them operators of the EILA programme unless expressly stated.
Where a partner has its own terms, safety requirements or policies applicable to a particular activity, learners and parents/guardians may also be required to comply with those requirements.
13Website Use
The information provided on the EILA website is intended to describe the programme and its activities.
EILA seeks to keep information accurate and current but does not guarantee that every piece of website content will always be complete, current or error-free.
Unauthorised attempts to interfere with the operation or security of the website are prohibited.
Users must not use the website to submit false, misleading, unlawful or abusive information.
14External Links
The EILA website may contain links to third-party websites and services.
These links are provided for convenience or information. EILA does not control and is not responsible for the content, security, availability or policies of external websites.
15Limitation of Responsibility
EILA takes reasonable measures to provide a safe, organised and meaningful learning environment.
However, participation in practical training involves inherent risks associated with tools, equipment, materials, movement and workshop activities.
EILA will not be responsible for loss or damage arising from circumstances beyond its reasonable control or from a participant's failure to follow safety instructions, except where responsibility cannot lawfully be excluded or limited.
Nothing in these Terms excludes or limits any liability or legal right that cannot lawfully be excluded or limited under applicable Kenyan law.
16Events Beyond Reasonable Control
EILA will not be considered in breach of these Terms where it is unable to provide a programme because of circumstances beyond its reasonable control, including natural disasters, severe weather, public emergencies, government restrictions, industrial action, venue closure, equipment failure, trainer unavailability or other unforeseen circumstances.
Where reasonably possible, EILA will seek to provide an alternative arrangement.
17Privacy
Personal information collected through registration, payment, enquiries and programme participation will be handled in accordance with the EILA Privacy Statement.
By registering, you acknowledge that you have had an opportunity to review the Privacy Statement.
18Complaints and Concerns
Parents, guardians and learners are encouraged to raise concerns promptly with the EILA programme team.
Complaints relating to registration, payments, training, conduct, safeguarding or personal information should be directed through the contact details provided on the EILA website.
EILA will seek to address complaints fairly and within a reasonable period.
19Changes to These Terms
EILA may update these Terms when its programmes, systems or operating arrangements change.
The current version will be published on the EILA website together with the date of the latest update.
20Governing Law
These Terms are governed by the laws of Kenya.
Any dispute relating to participation in an EILA programme will, where possible, first be addressed through good-faith discussion between the parties before any formal legal process is considered.
21Acceptance
By submitting a registration, making payment or participating in an EILA programme, the registering parent, guardian or participant confirms that they have read and understood these Terms and Conditions and agree to comply with them.
Where the participant is under 18, the parent or legal guardian accepts these Terms on behalf of the learner.
